1. Welcome to Bettermile
Your privacy is important to us.
1.1 Who we are
Bettermile is a product of GLS eCom Lab GmbH (“Bettermile”, “we”), which has developed a Software-as-a-Service product suite to digitize the last mile delivery journey.
1.2 What this Privacy Policy does
This Privacy Policy describes how Bettermile collects, uses, stores, shares, or otherwise processes, and secures your personal data. Personal data means any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
1.3 How this Privacy Policy applies
This Privacy Policy applies to the Bettermile Website, the use of the Bettermile App and BackOffice, and other interactions (e.g., customer service inquiries, Meetups, etc.) you may have with Bettermile. Depending on how you use our site or service, some parts of this policy might or might not apply to you – each chapter clearly explains if it applies to you. This Privacy Policy, however, is only intended to inform you about the processing activities that Bettermile conducts as a controller under applicable data protection law for its own purposes. If you use Bettermile services as part of your job (e.g. within the context of delivering parcels), a separate agreement governs delivery, access and use of Bettermile Services and the processing of personal data in this context (the “Framework Agreement” and the “Data Processing Agreement”, respectively). The organization (e.g. your employer or another entity or person) that entered into the Framework Agreement (“Customer”) controls any associated Customer Personal Data and is the responsible controller for the processing of your personal data. If you have any questions about specific settings and privacy practices, please contact your organization.
1.4 Visitors, Customers and App Users - Which one applies to me?
Bettermile is used by Visitors (people who visit our website, including general visitors who do not register for an account with us), Customers (the organization (e.g., your employer or another entity or person) that entered into the SaaS Agreement and uses our product suite, or an Authorized User that has an account in our Bettermile frontend platform, “Back Office”), and App Users (people who use the Bettermile App for Better Route). How we store and process your personal data depends a lot on whether you are a Visitor, Customer or App User so, we have split the following explanations into three parts.

2. Privacy for Visitors
2.1 Privacy for Visitors
If and while you visit our site www.bettermile.com, even without registering for an account, you are a “Visitor” of our website within the meaning of this Privacy Policy.
2.2 What data do we process about Visitors and how do we use it?
We process the following data from Visitors while they browse our site:
When you visit our website, the browser used on your end device automatically sends data (IP address and approximate location, access time, name and URL of the file accessed, referrer URL, browser used, OS, device type, and access provider) to our server where it's stored in log files.
Processing this data is necessary for delivering and securing the website, maintaining functionality, and supporting IT security. Further storage of the log files takes place in order to ensure statistics for the security of the information technology systems. The data is processed on the legal basis of Art. 6 (1) lit. b GDPR, insofar as the processing of personal data is necessary for the entering into or fulfilment of a contract and otherwise on the basis of our legitimate interests in the above-mentioned purposes, especially providing a functional and secure website in order to inform about our products and services as well as providing ways to get in contact with us, Art. 6 (1) lit. f GDPR.
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. The anonymized statistical data of the log files are kept accessible only to administrators.
In addition, we use cookies and similar technologies that process personal data when you visit our website to provide additional functionality as well as for analytics and marketing purposes. You can find more detailed explanations of this in section 2.3. of this privacy policy.
We use Prismic as a content management system for our website. This is a service provided by Prismic Networks, Inc. 185 Alewife Brook Parkway, #410 Cambridge, MA 02138. When you visit our website, data such as your IP address is transferred to Prismic servers to load the website content. Prismic Networks, Inc. ensures an adequate level of data protection through the EU Standard Contractual Clauses. Please find more information in their Privacy Policy.
We use cloud-based systems of Amazon Web Services, Inc (AWS) as our hosting service provider. We have agreed with AWS that data in this context is processed on servers in EU data centres. In exceptional cases, personal data may be transferred to the USA. Amazon Web Services Inc. is part of the AWS Group, which is certified under the EU-US Data Privacy Framework and falls under the EU adequacy decision for the US, provided that no data about the employment relationship or applicant data is processed. For this data processing, Amazon Web Services Inc. ensures an adequate level of data protection through the EU Standard Contractual Clauses. 2.3 Cookies and similar technologies
2.3.1 How do we use cookies and similar tools on our website?
Our website uses various services and applications (collectively "tools") that are offered either by us or by third parties. These include, in particular, tools that use technologies to store or access information in the end device:
- Cookies are small text files stored on your device. They may be session-based (deleted when you close your browser) or persistent (stored until a set expiration date or removed manually). They help the website function properly and may store preferences or usage data.
- Web storage includes local storage and session storage. Both store data as name-value pairs in your browser. Session storage is cleared when the session ends, while local storage remains indefinitely unless manually deleted or controlled by a set expiration mechanism.
- JavaScript is code that runs in your browser to enable interactive features. It can be used to set cookies, store data, collect usage information, or perform device fingerprinting and user profiling. Disabling JavaScript may limit website functionality.
- Pixels are tiny graphics that load automatically to track actions such as website visits or email opens. They collect standard connection data (like IP address, browser type, and time of access) and can be used for passive fingerprinting. Blocking images may prevent tracking but can affect how content is displayed.
Most browsers are set by default to accept cookies, the execution of scripts and the display of graphics. However, you can usually adjust the settings in your browser. If you completely deactivate them our services may not function properly or at all.

2.3.2 Legal basis
We use tools that are necessary for the operation of our website on the basis of our legitimate (Art. 6 (1) lit. f GDPR) in order to provide the basic functions of our website. In certain cases, these tools may also be necessary for the performance of a contract or for the implementation of pre-contractual measures (Art. 6 (1) lit. b GDPR). Access to and storage of information in the end device is absolutely necessary in these cases (§ 25 (2) Telecommunications Digital Services Data Protection Act (TDDDG)).
We use all other non-essential (optional) tools (functional, analytics or marketing tools) on the basis of your consent (Art. 6 (1) lit. a GDPR), prior to the processing and which you can revoke at any time. Access to and storage of information in the end device then takes place on the basis of § 25 (1) TDDDG.
2.3.3 How you can give and withdraw your consent
This website uses CookieHub, Kalkofnsvegur 2, 101 Reykjavík, Iceland as our consent manager. When you enter our website, CookieHub collects your consent(s) or withdrawal of your consent(s), IP address and approximate location of the viewer, Date and time of access, name and URL of the retrieved file, website from which the access is made (referrer URL), browser used, the operating system and device type of your end device, and the name of your access provider. CookieHub stores a cookie in your browser to track consent or withdrawal of consent, which is kept until deleted or no longer necessary. Legal obligations for data retention remain unaffected.
The legal basis for this is Art. 6 (1) lit. f GDPR, based on our legitimate interest in complying with regulatory requirements to collect and document consent. You can find more information in CookieHubs privacy policy.
You can withdraw and/or customize your consent to the use of (optional) tools at any time via the cookie settings (in the footer at the bottom of the website).
2.3.4 Essential tools
We use CookieHub, as mentioned above, to enable the basic functions of our website ("essential tools"). Without these tools, we would not be able to provide our website and services.
2.3.5 Functional tools
We also use optional tools to improve the user experience on our website and to offer you more functions ("functional tools"). Although these are not absolutely necessary for the basic functions of the website, they can bring considerable benefits to Visitors, particularly in terms of user-friendliness. This may include, in particular, the integration of external content such as maps and videos.
Vimeo
We have integrated videos into our website that are stored on the Vimeo video platform and can be played from our website. Vimeo is a multimedia service of Vimeo.com, Inc, 330 West 34th Street, 10th Floor, New York, New York 10001, USA ("Vimeo"). For this purpose, Vimeo uses JavaScript, which retrieves information from your end device, and uses cookies, which are stored on your end device. You can manage your preferences at any time via our Cookie Settings.
If you visit our site equipped with Vimeo videos and give us a corresponding consent by starting the video by clicking on "Play Video", and thus accept the Privacy Policy of Vimeo, a connection to the servers of Vimeo is established. In the process, the Vimeo server is informed which of our pages you have visited.
Data may be transferred to servers outside the EU, such as in the U.S., where Vimeo adheres to the EU-US Data Privacy Framework, ensuring data protection under the adequacy decision for the US.

Redocly
This website uses the service Redocly of the company Redocly Inc, 3801 N. Capital of Texas Hwy, E-240 #72, Austin, Texas 78746, USA. With Redocly we host our developer portal. For this purpose, Redocly can store user data such as browser information, operating system, time spent on the page, etc. You can prevent data processing by Redocly by not visiting our Developer Documentation service pages at docs.bettermile.com or by not following the "Developer Portal" link.
When using the service, data may be transferred to servers in third countries outside the European Union or the European Economic Area (e.g. the USA).

2.3.6 Analytics tools
To improve our website, we use optional tools to recognize visitors and to statistically record and analyze general usage behavior based on access data ("analytics tools"). We also use analytics tools to evaluate the use of our various marketing channels. The usage information collected is aggregated and enables us to track the usage habits of our visitors. This helps us to adapt and optimize the design of our website and make the user experience more pleasant.
Google Tag Manager
We use the service called Google Tag Manager from Google. "Google" is a group of companies and consists of Google Ireland Ltd (provider of the service), Gordon House, Barrow Street, Dublin 4, Ireland and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and other affiliates of Google LLC. In case Google transfers personal data to the US, Google LLC has joined the EU-US Data Privacy Framework, which is why the transfer in this case is based on the adequacy decision for the USA in accordance with Art. 45 GDPR.
The Google Tag Manager is an auxiliary service and itself processes personal data only for technically necessary purposes. The Google Tag Manager takes care of loading other components, which in turn may collect data. The Google Tag Manager does not access this data.

Google Analytics
Our website uses the service Google Analytics, a web analytics service provided by Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland hereinafter "Google"). In this context, pseudonymized usage profiles are created and cookies and similar technologies are used. The information generated by the cookie about your use of our website such as:
- IP address and approximate location of the viewer,
- Date and time of access,
- Name and URL of the file accessed,
- Website from which the access was made (referrer URL),
- Browser used, the operating system and device type of your end device, and the name of your access provider.

This serves to analyze your usage behavior and improve our website. We will process the information obtained to evaluate your use of the website and to compile reports on website activity for the website operator. As part of the evaluation, Google Analytics also uses artificial intelligence such as machine learning to automatically analyze and enrich the data.

Your personal data may also be transferred by Google Ireland Limited to Google LLC in the USA. Hotjar
Our website uses Hotjar, a web analytics service provided by Hotjar Ltd, Elia Zammit Street 3, St Julians STJ 1000, Malta ("Hotjar"), to better understand the interactions (e.g. how much time users spend on which pages, which links they click on, what they like and what they don't like, etc.) and needs of our users and to optimize the offer and experience on this website.
Hotjar uses JavaScript, cookies and information in local storage to perform various analyses and evaluations of your usage behavior and your interactions with our website (such as mouse movements, scrolls and clicks). Your IP address is anonymized before usage data analysis to protect your identity. Data on your interactions (like clicks, scrolls), device details (OS, browser, resolution, language), and geographic location are collected for statistical purposes.

2.3.7 Marketing Tools

Google Ads
Our websites use the "Google Ads" service, which is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. We use Google Ads to promote our offers on external websites and measure the success of our ad campaigns. Our goal is to display relevant ads, improve your experience, and fairly calculate advertising costs.
Google Ads uses cookies, JavaScript, pixels and other technologies for this purpose.These cookies usually lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognize that the user clicked on the ad and was redirected to this page. Each Google Ads customer receives a different cookie. Cookies can therefore not be tracked across Google Ads customers' websites. 2.4 Newsletter
If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address and agree to receive the newsletter. We use this data for sending the requested information. We also process information about your interactions with our newsletter (e.g. the opening and click-through rates of our newsletters) via tracking links or web beacons embedded in our newsletter and aggregate them in recipient profiles for the purpose of personalizing and designing future newsletters.
The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 (1) lit. a GDPR, § 25 (1) TDDDG). ActiveCampaign is a service with which, among other things, the sending of newsletters can be organized and analyzed. If you enter data for the purpose of receiving newsletters (e.g. e-mail address), this data is stored on ActiveCampaign's servers in the USA. In addition, technical information is recorded (e.g. time of retrieval, IP address, browser type and operating system). ActiveCampaign is certified under the EU-US Data Privacy Framework and falls under the EU adequacy decision for the US.

2.5 Application via the website
You have the possibility to apply for an open position via our website. This is done by clicking on the "Apply for this job" button and then entering the relevant information in the subsequent windows.
We use the tool “Ashby” as an applicant database for the purpose of processing the application. Ashby All in One is a service of Ashby Inc., 49 Geary Street Suite 411 San Francisco, CA 94108 US. In case Ashby transfers personal data outside of the European Union or European Economic Area, Ashby Inc. has joined the EU-US Data Privacy Framework, which is why the transfer in this case is based on the adequacy decision for the USA in accordance with Art. 45 GDPR.
In the case of application/registration, we process the data that you provide to us in the course of the application, in particular to conduct the application process, make an informed decision on your application and to communicate with you regarding the application process. In this context we process your applicant master data, e.g. your first and last name and your email address, if you have a work permit for Germany, and your CV (resume). If you choose to further provide optional information, we may also process the following: your phone number, availability date, desired salary, GitHub profile, LinkedIn profile, letter of motivation, job references, or other documents.
We only process the information provided by you within the context of your application, in particular to conduct the application process, make an informed decision on your application and to communicate with you regarding the application process. Your (mandatory) personal data is processed on the basis of Article 6 (1) lit. b GDPR for the purpose of deciding whether to establish an employment relationship with you and, if the application was successful, for the purpose of entering into the employment contract with you. The legal basis for processing optional information you may or may not provide, the legal basis is Article 6 (1) lit. a GDPR. It is completely up to you, if you want to share any optional information with us and choosing not to share it will have no bearing on the outcome of the application process. Mandatory information is indicated as such by an asterisk (*).
AI tools may be used to enhance our evaluation of your application. These tools are solely used to assist our recruiters in conducting a thorough and in-depth analysis of your application. We do not use automated decision-making and ensure careful human oversight is implemented whenever necessary. We are committed to using tools that do not use your information to train any deployed large language models.
If we think your application is promising, we would like to meet you in person. If the application process does not lead to an employment relationship, your data will be automatically deleted after a maximum of 6 months after we have informed you of the result of the application unless legal provisions require a longer retention period in accordance with the statutory periods. The legal basis for this is our legitimate interest according to Art. 6 (1) lit. f GDPR in being able to establish, exercise or defend legal claims.
With your consent, we may store your data in our applicant pool for 12 months, renewable with renewed consent (Art. 6(1)(a) GDPR). You can withdraw consent at any time (Art. 7(3) GDPR).
2.6 Meetups
Participation
You can register for our Last Mile Delivery Meetup event via this website, LinkedIn (LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland, LinkedIn’s parent company LinkedIn Corp takes part in the Data Privacy Framework and is therefore covered by the adequacy decision for the US), Meetup.com (Meetup LLC, 632 Broadway, New York, USA, privacy policy) or Eventbrite (Eventbrite, Inc., 95 Third Street, 2nd Floor, San Francisco, California, 94103 USA, privacy policy, Eventbrite takes part in the Data Privacy Framework and is therefore covered by the adequacy decision for the US). These service providers may process personal data for their own purposes, when you use their services to register for an event. In order to register you for the event, we process your title, first and last name, e-mail address, job title and company name, and the event location.
When you register, we use your data to create lists of participants with names and positions in order to organize the event. The legal basis is Art. 6 (1) lit. b GDPR as far as the organisation, implementation and handling of the event is concerned as well as Art. 6 (1) lit. f GDPR due to our legitimate interest in the preparation of the event.
Online live streaming for hybrid events
The Meetups may take place in a hybrid manner. If it takes place digitally, it will take place via livestream. For the implementation of the event, a stream on the website of following providers are used. These providers may process your personal data when viewing the livestream/recording:
- Restream.io is a third-party tool for multistreaming, recording live content, and integrating with onsite broadcasting equipment to stream to platforms like YouTube, LinkedIn, and X. Restream.io is a service by Restream, Inc. at 515 Congress Ave, Suite 1050, Austin, TX 78701, USA. Restream, Inc. ensures an adequate level of data protection through the EU Standard Contractual Clauses. Please find more information in restreams’ privacy policy.
- Zoom Virtual meeting software is used to live stream and record content, stream to platforms like YouTube and LinkedIn, and embed as a media player on websites. Zoom is a service of Zoom Communications, Inc. 55 Almaden Boulevard, 6 th Floor, San Jose, California 95113, USA. Please find more information in Zoom’ privacy policy. Zoom takes part in the Data Privacy Framework.
- YouTube is an embedded media player used on Bettermile web pages and on the YouTube site itself. Youtube is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Please find more information in Youtube’s privacy settings and policy. In case data is transferred to Google LLC in the USA, Google LLC takes part in the Data Privacy Framework.
- LinkedIn Live is used to stream video via the Bettermile LinkedIn page, allowing live broadcasts to profiles, pages, or events. LinkedIn Live is a service by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. Please find more information in LinkedIn’s privacy policy. In case data is transferred to LinkedIn Corp in the USA, LinkedIn Corp takes part in the Data Privacy Framework.
- X (formerly Twitter) is used to stream via Bettermile X business page and can be embedded on websites. X is provided by Twitter International Unlimited Company, One Cumberland Place, Fenian Street Dublin 2, D02 AX07, Ireland. Please find more information in X’ privacy policy. In case data is transferred to X Corp in the USA, X Corp takes part in the Data Privacy Framework.
The legal basis for processing personal data is Art. 6(1)(b) GDPR. If, in order to be able to provide online livestream, data is transferred to the USA or other third countries without safeguards like adequacy decisions or standard contractual clauses, it is done under Art. 49(1)(b) GDPR to fulfill a contract.
If you participate as a speaker and your recording is streamed or published, processing is based on your consent (Art. 6(1)(a) GDPR); in the absence of safeguards, it is done with your explicit informed consent under Art. 49(1)(a) GDPR.
Information about our products and services
If you have registered for any of our Last Mile Delivery Meetups as a participant or as a speaker we may send you information and marketing materials about the events you have registered for and about other Bettermile Meetups and products, if you have provided us your consent.
The legal basis is your consent according to Art. 6 (1) lit. a GDPR. If you no longer wish to receive such information, you can click the „unsubscribe“ link in the email or send us an email to info@Bettermile.com.
2.7 Contact Form
The data entered by you in the context of an inquiry in the contact form, such as subject, first name, last name, e-mail address, telephone number (optional), as well as your message to us are used to process and answer your inquiry.
The legal basis for the processing is Art. 6 (1) lit. b GDPR insofar as the processing is necessary for fulfilling or entering into a contract and otherwise our legitimate interests pursuant to Art. 6 (1) lit. f GDPR to process and answer your request. For optional entries it is your consent, Art .6 (1) lit. a GDPR.
If no contractual or legal retention periods are to be observed, your data will be stored for as long as necessary for the respective purpose, and for a maximum of two years.
2.8 External platforms
Our website contains links to some of our online profiles on the social media and publishing platforms listed below. A connection is only established when you click the link.
Once redirected, the respective platform may collect and process your data independently. We do not have access to this data. LinkedIn Company Profile
To operate the LinkedIn company profiles (GLS eCom Lab and Bettermile), we use the technical platform and services of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland (“LinkedIn”).
We may access aggregated demographics (such as age, gender, region, or country) and user interaction data (including likes, shares, subscriptions, and views) from LinkedIn to improve our company profile and content. This data cannot be traced back to individuals.
For data protection matters, please contact the social network provider directly, as they control the data. You may also contact us, and we will forward your request as needed.

We also use LinkedIn Ads, LinkedIn Analytics and LinkedIn Marketing Solutions which process usage data to generate website statistics, measure ad success, and show relevant ads. LinkedIn may combine data with your account and set cookies for tracking.
The processing of the users' personal data is based on the legitimate interests (Art. 6 (1) lit. f GDPR) of Bettermile in an optimal company presentation.
We may target ads via LinkedIn’s Matched Audiences using company lists, website visitors, or event interactions. We process this data based on your consent (Art. 6 (1) lit. a GDPR).
Medium
Medium is a service offered by A Medium Corporation, 760 Medium Street, San Francisco, CA 94102, USA, and is used by us to provide blog content. The legal basis is Art. 6 (1) lit. f GDPR. Our legitimate interest lies in the provision of company and service information via a blog.
We have no influence on Medium’s processing of personal data and only receive anonymous insights on the performance of our articles. 3. Privacy information for Customers and Authorized Users
3.1 Who is a Customer or an Authorized User?
If you enter into the SaaS Agreement and/or use our product suite, you are a Customer within the meaning of this Privacy Policy. If you have an account in our Bettermile frontend platform (Back Office), you are an Authorized User.
3.2 What is the scope of this section of the Privacy Policy?
This section of the Privacy Policy is about the data collected to execute our service agreements with our Customers and the data concerning Authorized Users' interactions with the BackOffice. It does not extend the data you work with in Back Office and that is needed to provide you with the Back Office service (e.g. email, role). Your organization, as our Customer, is the controller of this data. We process data on behalf of and according to the instructions of the controller.
3.3 What data do we process about Customers and Authorized Users and how do we use it?
We process your information as a Customer or an Authorized User in the same way as described in chapter 2 above when you use our website. Additionally, we process the following information from you when you use our service:

Customer data: We refer to customer data as data of the Authorized Users that we process only on behalf of the Customer, who acts as the data controller. This may include:
- Registration information: To transfer data or access our product suite, you must first create a Bettermile account. During the account registration process, whether initiated by you or a designated responsible person, we will collect the following information: your first and last name, email address, mobile phone number (for two-factor authentication), username, password, and company name.
- Account type data: When an account is created, there are different user roles across your organization. We store the same information as in the registration for all users of the organization for the duration of the user accounts.
- Data needed to provide support while using the services.
- Billing information: If you subscribe to one of our services, we will require you to provide your billing details, including your billing name, billing address, and additional financial information depending on the payment method you chose. We will also store information about your individual subscription plan (including the date when you sign-up and dates of any renewals).
The legal basis is Art. 6 (1) lit. b GDPR if you are the contracting party of the SaaS agreement and Art. 6 (1) lit. f GDPR if you are an Authorized User, based on our legitimate interest in providing, managing and invoicing the customer account.
Other than for managing the customer account and accounting/billing purposes, we use customer data only in order to provide our service to the controller in accordance with the controller’s instructions. For any processing of personal data in this context, the contracting party of the SaaS agreement is responsible as controller.
- Cookie information and usage data: We use cookies and similar technologies on our Websites and BackOffice to collect data on how you navigate and interact with our site, helping us improve our services. We do not use this data to identify you personally. You can find more details about how we use these technologies, and your opt-out controls and other options in section 3.4.2. of this Privacy Policy or in our cookies settings that you can find in the account settings. We will use this information to analyse the service in aggregate form to produce reports or benchmarks. This means that we may use your information for security and operations management, to create statistical analyses, and for research and development purposes. These analyses will not include personal data or data that would allow us to identify individuals. The legal basis is Art. 6 (1) lit. a GDPR, based on your consent.
3.4 With whom do we share your information?
Bettermile recognizes that you have entrusted us with safeguarding the privacy of your information. Because that trust is very important to us, we will disclose or share your information only in limited circumstances, in accordance with applicable law. In particular, we may disclose your information that is processed by Bettermile as controller:
3.4.1 Service Providers
Bettermile uses third-party service providers who help us to provide you with our services. These include data hosting service providers, and providers of web analytics tools.
AWS
We use cloud-based systems of Amazon Web Services, Inc (AWS). We have agreed with AWS that this data is processed on servers in EU data centres. In exceptional cases, personal data may be transferred to the USA. Amazon Web Services, Inc. is part of the AWS Group, which is certified under the EU-US Data Privacy Framework and falls under the EU adequacy decision for the US, provided that no data about the employment relationship or applicant data is processed. For this data processing, Amazon Web Services Inc. ensures an adequate level of data protection through the EU Standard Contractual Clauses.

We use this information to understand your interests, improve our products and services and to create a better user experience on our website. 3.5 Education Newsletter
If you would like to receive the Education Newsletter offered in BackOffice, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address and agree to receive the newsletter. We use this data for sending the requested information.
The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 (1) lit. a GDPR, § 25 (1) TDDDG). You can revoke your consent to this processing of the data at any time with effect for the future, for example via the "unsubscribe" link in each newsletter. The lawfulness of the data processing carried out before the withdrawal remains unaffected by the withdrawal.

For newsletter dispatch, we use the services of ActiveCampaign, ActiveCampaign LLC, 1 N Dearborn, 5th Floor, Chicago, Illinois 6060, USA.
ActiveCampaign is a service with which, among other things, the sending of newsletters can be organized and analyzed. If you enter data for the purpose of receiving newsletters (e.g. e-mail address), this data is stored on ActiveCampaign's servers in the USA. In addition, technical information is recorded (e.g. time of retrieval, IP address, browser type and operating system). ActiveCampaign is certified under the EU-US Data Privacy Framework and falls under the EU adequacy decision for the US.

4. Privacy information for App Users
4.1 Who is an App User?
If you have been provided with a device with the Bettermile App installed or downloaded our App directly to be used for navigation, you are an App-User within the meaning of this Privacy Policy.
4.2 What is the scope of this section of the Privacy Policy?
This section of the Privacy Policy explains the data that Bettermile processes as a controller for our own purposes. This section does not cover the data you use within the App for navigation services (e.g., location, tour, and device data). The entity entering into the SaaS agreement with us (such as your employer or contractor) is the controller of this data, and we process it on their behalf and according to their instructions.
4.3 What data do we process about App Users and how do we use it?
As explained before, the following information (Customer data) is processed by Bettermile on behalf and according to the instructions of the controller (e.g. your employer) in order to provide our services.
- Customer data: We refer to Customer data as data that we process on behalf of and on the instructions of the Customer, where the Customer is the controller of that data. This may include:
- General usage data: When using the app, personal data is processed in order to provide its core functionalities and ensure its security. This includes, in particular, data that is automatically collected by the end device, such as device type, operating system, IP addresses and device identifiers) and is generated during use (e.g. time and duration of use, interactions in the app, error messages).
- Registration information: You need a Bettermile account before you can transfer any data and access data for navigation. When your account is assigned by the Customer, we will process the information necessary to create the account including your first and last name, email address, mobile number (for two factor authentication), username, password, company name.
- Location data: To be able to provide you with our navigation service we need your actual location.
- WiFi Signals: To be able to identify what data can be sent and improve the precision of the location and improve the navigation. We do not use this data to identify you personally.
- Device Data: for example, device ID, for device management.
- Tour number and tour information: e.g. tour number, departure time, delivery, pick-up and collections locations, final destination, to be able to identify the tour you drive, provide all necessary information to you and provide you with accurate waypoints and navigation.
- Sensor data: specifically, gyroscope, acceleration, and magnetometer to be able to identify entrances and parking locations and display them to you in the app, helping you to optimize the last mile delivery. This data is not used to identify you personally. This is only enabled if your organization onboard the last meter functionality.
- Contact data: Name, phone number and email (if applicable. We use this data to communicate with you by responding to your requests, comments and questions, as part of our services to the Customer, your organization or employer.
This data is owned and managed exclusively by the Customer (the Customer is usually the same person that enabled your account). The Customer may provide you with their own data protection/privacy information by the time you enter a working or service relationship with them, and we encourage you to review that to understand how the Customer can handle your data (including with regard to the Bettermile App).
If you have any questions about it you can contact your employer or contractor, which is the controller of the data.
If you give us your explicit consent, we will process the following data for our own purposes:
- App Usage Data: Information about how you interact with our app. This includes the features you use, buttons or elements you click on, app launches and crashes, as well as location data such as city, country, ZIP code, region, continent, and subcontinent.
- Device and Application Data: technical details about the device and app environment, including device model, operating system, screen resolution, language settings, IP address, app version, update history, device ID, advertising ID, and instance ID.
We process device, application and service usage data to better understand how the App is used, to improve the services and the App and to create a better user experience for our App. We do not use this data to identify you personally or combine or otherwise associate this information with your Bettermile account.
4.4 With whom do we share your information?
4.4.1 Your organization
Via Back Office, tour and navigation data is also provided to our Customers so they are able to support you. We may provide statistical data to our Customers so they can understand their overall performance.
4.4.2 Consignees
If our customers use Better Tracking, the data processed within the app on behalf of our customer, will allow us to provide Real-Time-Tracking of parcels to the consignees, which includes Estimated Time of Arrival (ETA) and, in some cases, approximate vehicle location.
4.4.3 HERE
To provide you with the navigation services, we use HERE NAVIGATION SDK, provided by HERE Europe B.V. located in Kennedyplein 222-226, 5611 ZT Eindhoven,Netherlands . HERE may collect Location Data, Timestamp, Identifiers and characteristics of near-by Wi-Fi and Cellular network signals (such as received signal strength), application name and device model information. The information is collected with the purpose of improving HERE services and is processed based on your consent, which we collect within the Bettermile App, and you can withdraw at any time. This data does not serve to personally identify you.

4.4.4 Service providers
In our SaaS Agreement, your organization has agreed to the use of some service providers to be able to provide you and your organization with the contractual services.
We have an agreement in place where your organization has approved our use of certain third-party service providers. These providers help us deliver the services contracted with us. We've chosen them carefully to ensure quality and reliability. Your personal data is processed in accordance with Data Processing Agreements and applicable law. This ensures that your data is used only for purposes directly related to the services, and that it is kept confidential and secure.
4.4.5 Analytics
We use Google Analytics for Firebase to process the aforementioned App usage data and Device and application data. Google Analytics for Firebase makes it possible to analyze the use of our app. For this purpose, Google accesses identification numbers such as the instance ID of your app installation, the device ID and the advertising ID. Firebase Analytics is used to create usage reports, perform real-time analyses and segment target groups based on device data and usage data. We can use the statistics obtained to improve our app and services and make them more convenient for you as a user.
Google Analytics for Firebase or Firebase Analytics is a service by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. In case data is transferred to Google’s parent company Google LLC in the USA, Google LLC takes part in the Data Privacy Framework and is therefore covered by the adequacy decision for the US. Legal basis of this processing is your consent, Art. 6 (1) lit. a GDPR, § 25 (1) TDDDG.
You can revoke your consent at any time with effect for the future in the settings.
5. Data controller and data processor
Bettermile is the data controller for any Visitor information as well as Customer (authorized user of Back Office) and App-User information that we collect and process only in relation with the usage of our services. However, the Customer is the data controller for the data of the App-User and authorized users of Back Office. The Customer determines how the data is used. Bettermile processes such data only on behalf of and in accordance with the Customer’s instructions. If you have any questions about that data, please contact the Customer.
In case Bettermile would like to process additional data on the use of our website, app or in our services, we will only do so if you have given us your explicit consent. In this case, Bettermile is the controller for the processing of your personal data.
6. How long do we store your data?
In principle, we only store personal data for as long as necessary to fulfil the purposes for which we collected the data. After that we will store your personal data in accordance with applicable statutory retention periods. After expiration of that period, the corresponding data will be routinely deleted, as long as it is no longer necessary for the fulfillment of the services.
If you are a Customer and have an agreement with us, upon termination of the contract, all data and content associated with your account will be permanently deleted from our systems, in accordance with applicable laws and the Data Processing Agreement. This data cannot be recovered. We do not assume liability for any loss or damage arising from the cancellation, and it is your responsibility to ensure that any essential data or content is backed up or saved before initiating the cancellation process.
Notwithstanding the above, we will retain and use your information and data to comply with our legal obligations (including any statutory retention periods), to resolve disputes, or enforce our agreements. The legal basis is Art. 6 (1) lit. c GDPR, insofar as there is an obligation to further store the data and in all other cases Art. 6 (1) lit. f GDPR, based on our legitimate interests in being able to establish, exercise or defend legal claims. We may also retain and use your information to the extent such information is incorporated in any of our statistical analyses, reports and benchmarks. Please note that these analyses, reports and benchmarks will not incorporate your information in a form that could identify or reasonably serve to identify any individual.
7. Recipients of personal data and third country data transfers
In addition to the service providers mentioned in this Privacy Policy, some processing may be done by service providers, such as data centers, software and IT service providers, market research firms, and consultants. These providers are bound by contracts, operate under our guidelines, implement security measures, and are regularly monitored by us. In addition, data may be passed on in connection with official inquiries, court orders and legal proceedings if this is necessary for legal reasons. The data processed by us will only be passed on if there is a legal basis for this under data protection law in the specific case
We use services whose providers are partly located or process personal data in so-called third countries (such as the USA), i.e. countries whose level of data protection does not correspond to that of the European Union. If this is the case and the European Commission has not issued an adequacy decision for these countries (Art. 45 GDPR), we have taken appropriate precautions to ensure an adequate level of data protection for any data transfers. These include the standard contractual clauses of the European Union or binding corporate rules. Where this is not possible, we base the data transfer on exceptions under Art. 49 GDPR. If a transfer to a third country takes place and there is no adequacy decision or appropriate safeguards, it is possible and there is a risk that authorities in the respective third country (e.g. government agencies, security services) may gain access to the transferred personal data, possibly affecting your ability to exercise your data subject rights.
8. No Automated decision-making
Insofar as Bettermile is controller with regards to your personal data, there is no automated decision-making (Art. 22 GDPR) taking place.
9. How you can control your data (your data protection rights)
9.1 Your rights as a data subject in general
Your rights in respect to our processing of your personal data include the following:
- Right of access: You may obtain from the Controller free information about your personal data that is stored with and processed by the controller at any time, as well as a copy of this information, in accordance with Article 15 GDPR.
- Right to rectification: If you believe any of the personal data that the controller stores or processes about you is inaccurate or incomplete, you may request rectification of such incorrect or incomplete data, in accordance with Article 16 GDPR.
- Right to erasure (right to be forgotten): Where certain conditions are met, you may request erasure of your personal data at any time, in accordance with Article 17 GDPR.
- Right to restriction of processing: Where certain conditions are met, you may obtain from the controller a restriction of processing, in accordance with Article 18 GDPR.
- Right to object: At any time, you may object, on grounds relating to your particular situation, to the processing of your personal data, in accordance with Article 21 GDPR.
- Right to data portability: You have the right to receive the personal data concerning you, which was provided to the controller, in a structured, commonly used and machine-readable format, in accordance with Article 20 GDPR.
- Right to withdraw consent: Where our processing of your personal data is based on your consent, you may withdraw your consent at any time, without affecting the lawfulness of the processing based on your consent before its withdrawal, in accordance with Article 7 (3) GDPR.
- Right to lodge a complaint: If you feel that any of our data processing measures or means are in violation of applicable law, you have the right to lodge a complaint with a supervisory authority, in accordance with Article 77 GDPR.
9.2 How can you exercise your data subject rights?
If you wish to exercise your rights as a data subject or withdraw your consent, please send a message to datenschutz@Bettermile.com explaining which right you wish to exercise so that we can take the further steps necessary to exercise your rights. Please note, however, that we may require proof of identity to protect your personal data from unauthorized access or unauthorized changes.
If you are an App-User or an authorized user of Back Office, please note that your Customer personal data (as described above) is managed and controlled exclusively by the Customer – Bettermile processes such data only on behalf of the Customer, and in accordance with the Customer’s instructions. If you would like to review, correct, delete, restrict or block your Customer data or otherwise exercise your data protection rights vis-à-vis the Customer as the controller, we ask that you please contact the Customer directly. Particularly, if you are an authorized user of Back Office, you may modify your personal information by contacting the person within your organization with permission to modify accounts or Bettermile support. Permissions are managed by Bettermile and are linked to the role that the Customer or your organization assigned to you as an authorized user.
10. Data Security
The servers that we use to host our websites, apps and services are located in Germany, a Member State of the European Union, or another signatory to the Agreement on the European Economic Area.
We use appropriate technical and organizational security measures to protect your data, especially against accidental or intentional manipulation, partial or complete loss, destruction and against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
11. Changes to this Privacy Policy
This privacy policy is currently valid and has the status January 2026. Due to the further development of our website and offers on it as well as the app or due to changed legal or regulatory requirements, it may become necessary to change this privacy policy.
